LUSCIOUS DIAMONDS — TERMS OF SERVICE

These Terms of Service ("Terms") are between you and Luscious Diamonds Inc., carrying on business as Luscious Diamonds ("Luscious Diamonds," "we," "us," or "our") and govern your access to and use of the Luscious Diamonds website, online store, products, services and related features (collectively, the "Services").

All purchases and transactions made through the Services are transactions with Luscious Diamonds Inc.

"You" and "your" refer to the person accessing or using the Services, communicating with us, creating or accessing a customer account, or purchasing products from us.

By accessing our website, creating or accessing an account, or placing an order, you agree to these Terms and our Privacy Policy.

Our Return, Refund & Cancellation Policy, Shipping & Delivery Policy, applicable product disclosures and any additional terms clearly presented in connection with a particular transaction may also apply.

Nothing in these Terms excludes, restricts or waives any consumer right or remedy that cannot legally be excluded, restricted or waived.

1. CORPORATE IDENTITY & ELIGIBILITY

Luscious Diamonds is operated by Luscious Diamonds Inc.

All contracts, purchases and transactions entered into through the Services are with Luscious Diamonds Inc., unless expressly stated otherwise in writing.

Directors, officers, shareholders, employees, contractors and representatives acting on behalf of Luscious Diamonds Inc. are not individually parties to a customer transaction solely because they act for the corporation, except where applicable law provides otherwise.

By using the Services or placing an order, you represent that you have the legal capacity to enter into a binding agreement.

You may not use the Services for any unlawful, fraudulent or unauthorized purpose.

2. CUSTOMER ACCOUNTS & ACCOUNT SECURITY

Customer accounts may be made available through Shopify or other authorized technology providers.

Our current Shopify customer-account experience may use email-based authentication and a secure one-time verification code rather than a traditional password.

You are responsible for maintaining the security of:

  • Your email account.

  • One-time verification codes.

  • Devices used to access your account.

  • Other authentication information associated with your account.

You should not provide authentication codes or account-access information to unauthorized persons.

You are responsible for information and activity submitted through your account to the extent permitted by applicable law.

Contact Luscious Diamonds promptly if you believe your account or order information has been accessed without authorization.

3. PRODUCT INFORMATION & PRESENTATION

We make reasonable efforts to present our jewellery, laboratory-grown diamonds, gemstones, precious metals and other products accurately.

Because products are displayed digitally, colours, scale, proportions, brilliance, fire, reflections, textures and other visual characteristics may vary depending on:

  • Photography.

  • Lighting.

  • Video.

  • CAD rendering.

  • Image processing.

  • Screen settings.

  • Device characteristics.

Images, videos and renderings may be enlarged, reduced or presented for illustrative purposes so product details can be viewed clearly and should not necessarily be interpreted as representing actual scale.

Fine jewellery is individually manufactured and finished. Reasonable variations may therefore occur in:

  • Dimensions.

  • Measurements.

  • Metal weight.

  • Carat weight.

  • Stone positioning.

  • Finishing.

  • Other manufacturing characteristics.

Weights or measurements identified as approximate or with a “±” tolerance may vary within reasonable manufacturing tolerances.

Reasonable visual or manufacturing variations do not, by themselves, establish that a product is defective or materially different from the product ordered.

4. LABORATORY-GROWN DIAMONDS

Unless expressly stated otherwise, diamonds represented or sold by Luscious Diamonds are laboratory-grown diamonds.

Laboratory-grown diamonds are produced through technological processes rather than mined from the earth.

Product information may identify characteristics such as:

  • Carat weight.

  • Shape.

  • Measurements.

  • Colour.

  • Clarity.

  • Cut.

  • Polish.

  • Symmetry.

  • Other applicable quality characteristics.

We make reasonable efforts to ensure that information displayed for a specific diamond corresponds with applicable supplier information and independent laboratory documentation where provided.

5. DIAMOND REPORTS, CERTIFICATION & APPRAISALS

Where a product is represented as including independent diamond documentation, the applicable IGI grading report, GIA report, GIA laboratory-grown diamond quality assessment or other identified independent laboratory documentation, as applicable, forms part of the relevant product information.

Independent laboratories establish and apply their own:

  • Methodologies.

  • Terminology.

  • Standards.

  • Grading practices.

  • Reporting formats.

These may differ between laboratories and may change over time.

Where there is an apparent inconsistency between a website summary for a specific diamond and the independent laboratory documentation associated with that diamond, please contact Luscious Diamonds so the information can be reviewed.

Characteristics assessed by an independent laboratory should be verified by reference to the applicable laboratory report or assessment.

Where a product listing states that independent diamond documentation is included, the specific documentation supplied will depend on the applicable diamond and laboratory.

Any appraisal supplied by Luscious Diamonds or an independent appraiser represents an opinion of value for the purpose and date stated.

An appraisal, grading report, certificate or quality assessment does not guarantee:

  • Future market value.

  • Resale value.

  • Investment performance.

  • Future replacement value.

  • Future retail price.

6. MADE-TO-ORDER PRODUCTS

Luscious Diamonds jewellery is generally made to order.

We do not maintain finished jewellery as standard ready-to-ship inventory.

Depending on the product, an order may involve:

  • Diamond sourcing.

  • Precious-metal sourcing.

  • Material allocation.

  • Manufacturing.

  • Stone setting.

  • Engraving.

  • Customization.

  • Finishing.

  • Quality inspection.

  • Independent laboratory documentation.

  • Final preparation for shipment.

Unless otherwise stated on the applicable product page, most orders require approximately 4–6 weeks for production and processing before shipment.

Production and processing time is separate from carrier transit time.

7. PRICES, DYNAMIC PRICING, TAXES & CURRENCY

Prices may vary according to factors including:

  • Diamond selection.

  • Carat weight.

  • Metal type.

  • Metal weight.

  • Size.

  • Product configuration.

  • Customization.

  • Market conditions.

  • Currency.

  • Other applicable specifications.

Diamond and precious-metal prices may be market-sensitive.

Where indicated on our website, product pricing may update periodically to reflect changes in precious-metal prices, diamond prices, currency or other relevant market information.

A price viewed at one time may therefore differ from a price displayed later.

The price displayed at checkout when an order is submitted will normally be the applicable transaction price, subject to these Terms and correction of genuine errors where permitted by law.

Once an order has been accepted and payment successfully processed, subsequent market fluctuations will not normally change the confirmed purchase price.

Customer-requested modifications may change the price.

Applicable taxes will be calculated as required.

Unless expressly stated otherwise, duties, import charges, brokerage charges or other third-party charges associated with international delivery may be additional.

Where products are displayed in currencies other than Canadian dollars, exchange rates may fluctuate.

Banks, card issuers or payment providers may apply currency-conversion rates or fees over which Luscious Diamonds has no control.

8. PRODUCT DISCLAIMER & CUSTOMER SELECTIONS

Each jewellery piece is made to order and may vary slightly in:

  • Metal weight.

  • Carat weight.

  • Dimensions.

  • Colour.

  • Finish.

  • Other reasonable manufacturing characteristics.

Listed metal weight may represent an approximate base or expected weight for standard listed configurations and may vary.

Customers are responsible for reviewing applicable selections before completing a purchase, including:

  • Product design.

  • Diamond specifications.

  • Metal.

  • Size.

  • Engraving.

  • Personalization.

  • Quantity.

  • Shipping information.

Sizes or specifications outside listed product options may require separate assessment and pricing.

9. ERRORS, OMISSIONS & INACCURACIES

Luscious Diamonds makes reasonable efforts to ensure that information presented through the Services is accurate and current.

Information may occasionally contain typographical errors, omissions, technical errors or data inconsistencies relating to matters including:

  • Product descriptions.

  • Diamond information.

  • Measurements.

  • Carat weight.

  • Metal weight.

  • Grading information.

  • Images or renderings.

  • Availability.

  • Pricing.

  • Precious-metal pricing.

  • Currency conversion.

  • Promotions.

  • Discounts.

  • Taxes.

  • Shipping.

  • Delivery estimates.

  • Product configurations.

  • Website calculations.

  • Third-party information.

Certain information may originate from independent laboratories, manufacturers, suppliers, carriers, payment providers, market-data providers, technology providers or other third parties.

We may reasonably rely on information supplied by such parties.

Subject to applicable law, Luscious Diamonds may correct errors, omissions or inaccuracies and update information when identified.

If a material error affects an order you have submitted, we may contact you with corrected information and, where permitted by law, provide you with an opportunity to:

  • Proceed with the corrected order; or

  • Cancel the affected order.

If Luscious Diamonds cancels an affected order after collecting payment, the applicable amount paid for the cancelled product will be refunded to the original payment method.

10. ORDERS & ORDER ACCEPTANCE

Submitting an order constitutes an offer to purchase and does not necessarily mean that Luscious Diamonds has accepted the order.

We may review orders for matters including:

  • Payment authorization.

  • Product availability.

  • Diamond availability.

  • Component availability.

  • Pricing accuracy.

  • Product specifications.

  • Configuration feasibility.

  • Order quantity.

  • Multiple-unit purchasing.

  • Bulk or commercial purchasing.

  • Wholesale or resale indicators.

  • Comparison-purchasing activity.

  • Related or split orders.

  • Fraud prevention.

  • Shipping feasibility.

  • Regulatory requirements.

  • Legal restrictions.

Subject to applicable law, an order may be accepted when we communicate acceptance or commence fulfilment.

We may decline, limit or cancel an order where reasonably necessary, including where:

  • A product, diamond or component is unavailable.

  • Payment cannot be authorized.

  • Fraud or unauthorized activity is reasonably suspected.

  • A material pricing or product-information error has occurred.

  • A requested configuration cannot reasonably be manufactured.

  • Shipping or regulatory restrictions prevent fulfilment.

  • Separate commercial or verification terms are reasonably required.

  • The order violates these Terms or applicable law.

If we cancel an order after collecting payment, the applicable amount will be refunded in accordance with applicable law.

11. REVIEWING & CORRECTING ORDER INFORMATION

Before submitting an online order, customers should review the transaction information presented during checkout.

This may include:

  • Product.

  • Diamond.

  • Metal.

  • Size.

  • Engraving.

  • Personalization.

  • Quantity.

  • Billing information.

  • Shipping information.

  • Price.

  • Applicable taxes and charges.

Our checkout process is intended to provide an opportunity to review transaction information and correct errors before completing the purchase.

If you identify an error after submitting an order, contact Luscious Diamonds as soon as possible.

We will make reasonable efforts to assist where processing, sourcing, production or fulfilment has not progressed beyond the point at which the requested change can reasonably be made.

12. ORDER CONFIRMATION & ELECTRONIC AGREEMENTS

Orders placed through our online store constitute electronic transactions.

Order confirmations, receipts, these Terms, applicable policies and other transaction-related information may be provided electronically where permitted by law.

Please retain your order confirmation and applicable transaction records.

Nothing in this section limits requirements imposed by applicable consumer-protection law regarding information that must be disclosed or provided to a customer.

13. ORDER CANCELLATIONS

Eligible orders may have a 15-minute self-service cancellation window after purchase where the cancellation option is available through our online store.

After this period, contact Luscious Diamonds as soon as possible if you wish to request cancellation.

Because payment processing, diamond sourcing, material allocation, design preparation, manufacturing, customization and fulfilment may begin shortly after an order is confirmed, we cannot guarantee that a voluntary cancellation request can be accommodated once processing has begun.

Once an order has entered sourcing, processing, production, customization or fulfilment, it may no longer be eligible for voluntary cancellation.

Bespoke, personalized, engraved, resized, altered or specially modified products may be subject to additional cancellation restrictions once sourcing, customization or production has begun.

Where a cancellation can still be accommodated after the self-service cancellation period, Luscious Diamonds may advise you of any applicable costs before processing the cancellation.

The complete terms governing voluntary cancellations are contained in our Return, Refund & Cancellation Policy.

Nothing in this section limits a cancellation right that cannot legally be excluded.

14. ORDER CHANGES

If you wish to change an order, contact Luscious Diamonds as soon as possible.

Changes cannot be guaranteed once processing has begun.

Where a change can be accommodated:

  • Additional charges may apply.

  • Production timelines may change.

  • Delivery estimates may change.

  • Revised product or design approval may be required.

A request to change an order does not suspend or cancel production unless Luscious Diamonds confirms the change in writing.

15. CUSTOM, BESPOKE, PERSONALIZED, ENGRAVED & ALTERED PRODUCTS

Bespoke, custom-designed, personalized, engraved, resized, altered or specially modified jewellery may be subject to additional cancellation restrictions and may be final sale.

This may include:

  • Bespoke jewellery.

  • Custom-designed jewellery.

  • Engraved or personalized jewellery.

  • Jewellery resized or altered after production.

  • Special modifications requested by the customer.

  • Customer-approved bespoke or custom CAD designs.

  • Products specifically identified as Final Sale before purchase.

Where CAD drawings, renderings or other pre-production visuals are provided for customer review, these are intended to communicate the general design, proportions and characteristics of the product.

Reasonable manufacturing differences may occur.

Standard Luscious Diamonds catalogue designs are not excluded from our 7-Day Limited Return Policy solely because they are made to order, provided they otherwise satisfy all applicable eligibility requirements.

16. RING SIZING & FIT

Customers are responsible for selecting the correct ring size before ordering.

Sizing guides and measurement information are provided as general assistance.

Fit may vary depending on factors including:

  • Ring width.

  • Design.

  • Finger shape.

  • Temperature.

  • Individual preference.

An incorrect size selected by the customer is not, by itself, a product defect.

Where technically possible, resizing may be available as a separate service subject to:

  • Feasibility.

  • Design limitations.

  • Applicable charges.

  • Processing time.

Certain settings and jewellery constructions may not be suitable for resizing.

Jewellery resized or altered after production is not eligible for voluntary return.

17. PRODUCT & DIAMOND AVAILABILITY

Product, diamond and component availability may change without notice.

Certain diamonds and components may be sourced through suppliers or professional sourcing networks and may become unavailable before an order is fully processed.

If an ordered diamond, product or component becomes unavailable, we may contact you regarding an appropriate alternative.

If a suitable alternative cannot be provided or agreed upon, we may cancel and refund the affected item or order in accordance with applicable law.

18. PROMOTIONS, DISCOUNTS & GIFT CARDS

Promotional offers, discount codes and incentives may be subject to:

  • Eligibility requirements.

  • Minimum purchase requirements.

  • Product exclusions.

  • Expiry dates.

  • Availability.

  • Quantity restrictions.

  • Additional promotional terms.

Unless expressly stated otherwise, promotions may not be combined.

Sale or promotional merchandise may be identified as Final Sale where clearly disclosed before purchase.

Gift cards are generally non-refundable except where required by law.

Luscious Diamonds gift cards do not expire.

19. SHIPPING & DELIVERY

Unless otherwise stated on the applicable product page, most orders require approximately 4–6 weeks for production and processing before shipment.

Carrier transit time begins after production and final quality review are complete and the order is dispatched.

Available shipping methods and estimated carrier transit times may be displayed at checkout or otherwise communicated before shipment.

Production, processing, shipping and delivery dates are estimates unless expressly guaranteed in writing.

Luscious Diamonds offers complimentary insured shipping where stated on our website or at checkout.

20. DELIVERY SECURITY & RISK

Fine-jewellery shipments may be subject to security measures including:

  • Tracking.

  • Insurance.

  • Signature-required delivery.

  • Delivery verification.

  • Address verification.

  • Identity verification where appropriate.

Customers are responsible for providing accurate delivery information and making reasonable arrangements to receive signature-required deliveries.

Questions involving risk of loss, damaged shipments, missing shipments or non-delivery will be handled in accordance with applicable law and our Shipping & Delivery Policy.

21. INTERNATIONAL ORDERS, DUTIES & TAXES

International shipping may be available to eligible destinations.

Unless expressly stated as included at checkout, customers outside Canada may be responsible for:

  • Customs duties.

  • Import taxes.

  • VAT or similar taxes.

  • Brokerage charges.

  • Carrier handling charges.

  • Other charges imposed by the destination jurisdiction.

Where applicable, the recipient may be considered the importer of record and may be responsible for local import requirements.

Customs authorities may inspect, delay, hold or restrict shipments. These processes are outside our direct control.

Nothing in these Terms limits mandatory consumer rights that apply to an international transaction.

22. RETURNS, REFUNDS & EXCHANGES

Returns, refunds and cancellations are governed by our current Return, Refund & Cancellation Policy.

Luscious Diamonds offers a 7-Day Limited Return option on eligible purchases, subject to:

  • Return Authorization.

  • Eligibility requirements.

  • Exclusions.

  • Inspection.

  • The applicable 15% restocking fee.

A voluntary Return Authorization request must be submitted within 7 calendar days of confirmed delivery.

Approved voluntary returns must satisfy the requirements set out in our Return, Refund & Cancellation Policy.

Customers are responsible for insured and traceable return shipping for voluntary returns, except where otherwise required by applicable law.

The 15% voluntary-return restocking fee does not apply where Luscious Diamonds verifies that a product is defective, incorrect or otherwise requires a remedy under applicable law.

Luscious Diamonds does not offer conventional exchanges.

Where an eligible return is approved, the customer may place a separate order for the preferred product.

23. MULTIPLE-ITEM, BULK & COMPARISON PURCHASES

Orders containing three or more jewellery pieces, multiple quantities of the same or substantially similar design, or purchases reasonably identified as bulk, comparison, commercial, wholesale or resale orders are not eligible for voluntary return unless otherwise agreed in writing before purchase.

Related or split orders may be considered together where they reasonably appear to form part of the same bulk, comparison, commercial, wholesale or resale purchase.

These restrictions apply to our voluntary return program and do not restrict rights or remedies that cannot legally be excluded.

24. DAMAGED, DEFECTIVE, INCORRECT OR MATERIALLY DIFFERENT PRODUCTS

Customers should inspect their order promptly after delivery.

If you believe a product:

  • Arrived damaged.

  • Is defective.

  • Is not the item ordered.

  • Is incomplete.

  • Is materially different from the applicable order specifications.

We may request information including:

  • Your order number.

  • Photographs.

  • Video.

  • Packaging photographs.

  • Relevant documentation.

  • Return of the jewellery for inspection.

Where Luscious Diamonds verifies an error, defect, shipping damage or other issue requiring a remedy, the matter will be addressed in accordance with applicable law and the circumstances of the order.

The voluntary-return restocking fee does not apply where Luscious Diamonds verifies that an item requires a remedy under applicable law.

25. WARRANTIES & JEWELLERY CARE

Any specific written warranty offered by Luscious Diamonds will be governed by the terms accompanying that warranty.

Fine jewellery naturally experiences wear over time.

Except where otherwise expressly provided and subject to applicable law, a voluntary warranty may not cover matters including:

  • Ordinary wear.

  • Scratches.

  • Accidental damage.

  • Impact damage.

  • Loss.

  • Theft.

  • Improper use.

  • Improper storage.

  • Improper cleaning.

  • Unauthorized alterations.

  • Repairs performed by third parties.

Customers should periodically inspect jewellery for loose stones, worn prongs, damaged clasps and other maintenance needs.

Nothing in these Terms excludes statutory warranties, implied conditions or consumer protections that cannot legally be excluded.

26. THIRD-PARTY PRODUCT INFORMATION

Certain product or transaction information may originate from:

  • Manufacturers.

  • Diamond suppliers.

  • Independent grading laboratories.

  • Logistics providers.

  • Market-data providers.

  • Payment providers.

  • Technology providers.

  • Other third parties.

We make reasonable efforts to present this information accurately but may reasonably rely on information supplied by such parties.

If we become aware that material information is inaccurate, we may correct or update it subject to applicable law.

27. INTELLECTUAL PROPERTY

The Luscious Diamonds name, logos, branding, original website copy, original graphics, website design elements and other original materials are owned by, licensed to, or otherwise lawfully used by Luscious Diamonds Inc., as applicable.

Certain photographs, videos, CAD files, jewellery designs, renderings, graphics, models or other materials displayed through the Services may be:

  • Licensed.

  • Purchased.

  • Supplied.

  • Otherwise obtained from third-party providers.

Nothing in these Terms represents that Luscious Diamonds Inc. owns the underlying copyright or other intellectual property rights in every third-party asset displayed through the Services.

Rights in third-party materials remain subject to the rights of their respective owners and applicable licences, permissions or other rights of use.

You may not reproduce, redistribute, commercially exploit, scrape or systematically extract protected original Luscious Diamonds content except with our permission or as otherwise permitted by law.

28. SIMILAR & NON-EXCLUSIVE PRODUCTS, DESIGNS AND MEDIA

The jewellery industry commonly uses established:

  • Jewellery styles.

  • Stone shapes.

  • Settings.

  • Proportions.

  • Manufacturing techniques.

  • CAD libraries.

  • Design elements.

Certain products, designs, photographs, videos, renderings or other assets displayed or offered through the Services may be sourced from third-party providers on a non-exclusive basis.

Identical or substantially similar products, designs or visual materials may therefore also be available from manufacturers, retailers or other businesses.

Unless expressly stated otherwise in writing, Luscious Diamonds does not represent that every product design or third-party visual asset displayed through the Services is exclusive to Luscious Diamonds.

29. INTELLECTUAL PROPERTY CONCERNS

Luscious Diamonds respects the intellectual property rights of others.

If you believe that material displayed through our Services infringes a copyright, trademark or other intellectual property right that you own or are authorized to enforce, please contact us.

Where reasonably available, include:

  • Your name and contact information.

  • Identification of the protected work or right.

  • Identification or URL of the material concerned.

  • An explanation of your claimed rights.

  • Supporting documentation where appropriate.

We may investigate the matter and, where appropriate, remove, restrict, replace or modify the material.

Taking such action does not by itself constitute an admission of infringement, liability or wrongdoing.

30. PROHIBITED USES

You may not use the Services:

  • For unlawful or fraudulent activity.

  • To interfere with website security or operation.

  • To introduce malicious software or harmful code.

  • To impersonate another person.

  • To obtain unauthorized access to systems or information.

  • To infringe intellectual-property, privacy or other legal rights.

  • To systematically scrape or extract protected website content for unauthorized commercial exploitation.

  • To circumvent security, fraud-prevention, return-policy or access-control measures.

We may restrict access where reasonably necessary to address misuse or protect the Services.

31. THIRD-PARTY SERVICES & LINKS

The Services may contain links to or integrations with third parties, including:

  • Shopify.

  • Payment processors.

  • Social networks.

  • Shipping providers.

  • Financing providers.

  • Independent grading laboratories.

  • Other websites or services.

Third-party services operate independently and may be governed by their own terms and privacy policies.

To the extent permitted by law, Luscious Diamonds is not responsible for the independent acts, omissions, content, policies or practices of third parties that we do not control.

32. WEBSITE AVAILABILITY

We make reasonable efforts to maintain the availability and functionality of our website but do not guarantee uninterrupted or error-free operation.

The Services may occasionally be unavailable or affected by:

  • Maintenance.

  • Third-party systems.

  • Telecommunications failures.

  • Cybersecurity issues.

  • Software issues.

  • Circumstances outside our reasonable control.

We may modify, suspend or discontinue website functionality where reasonably necessary.

33. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Luscious Diamonds Inc. and its directors, officers, employees, contractors and agents, when acting in their respective capacities for the corporation, will not be liable for indirect, incidental, special or consequential losses arising from use of the Services or products where such liability may lawfully be excluded or limited.

Nothing in these Terms creates personal contractual liability for a director, officer, shareholder, employee, contractor or representative solely because that person acts on behalf of Luscious Diamonds Inc.

To the extent permitted by applicable law, where Luscious Diamonds is liable in connection with a particular purchase and that liability may lawfully be limited, our aggregate direct liability relating to that purchase will not exceed the amount actually paid to Luscious Diamonds for the product or order giving rise to the claim.

This section does not exclude or limit liability where exclusion or limitation is prohibited by law.

Nothing in these Terms excludes or restricts:

  • Statutory consumer rights.

  • Applicable implied conditions or warranties.

  • Liability that applicable law does not permit us to exclude or limit.

  • Other rights or remedies that cannot legally be waived.

34. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless Luscious Diamonds Inc. and its directors, officers, employees and agents from third-party claims, liabilities, losses and reasonable costs arising directly from:

  • Your unlawful use of the Services.

  • Materials you submit that infringe another person's rights.

  • Your material violation of these Terms.

  • Fraudulent or intentionally wrongful conduct by you.

This section does not require a consumer to indemnify Luscious Diamonds for our own negligence, misconduct or breach of applicable law.

35. EVENTS OUTSIDE OUR REASONABLE CONTROL
